Pokemon MMO's being shutdown
« on: March 10, 2011, 08:50:49 PM »
One day i was searching Pokemon MMO's cause i was looking for a certain one and i had found that a lot of online Pokemon games had been shut down (including the one i was searching for) by Nintendos legal rep. Miller Nash and i was wondering if any one can shed some light on the subject cause as far I know none of them ever broke copyright laws (I've at one point in time played them.) is it just Nintendo being an (pardon my language) a-hole or what?

Simple.
Nintendo owns the rights to:
- All Pokémon related material including Name, Graphics and Code (that is made by them)
- Distribute this content as they themselves please
- Claim copyright against people who rip their work, and use it to make an mmo.

A) Had a heart-attack when I saw the name of this thread. Damn you.

B) Baka... hate to be a woman, but if they own the rights to the names, then what does that include? All Pokémon names, or character names like Professor Oak etc.?

EDIT: Love how (female-dog) has been filtered to 'woman'. This makes the word an insult.

We take precautions.
- Our game is not a competing project to the original Pokemon games that Nintendo distribute.
- We support the original games, and encourage our community to do the same.
- We do not take donations or payment. Spend them on the original games.
- Our source or graphics are not owned by nintendo, hence we can use it for other stuff should Nintendo still consider us a threat.

Both yes and no.
PU as a community and game server can be taken down.
PU as a MMO source, cannot be taken down, as long as its free of Nintendo copyrighted content.

If they own all of the names of Pokémon... then how the who are you going to get past that? Peekachoo... Bewlbasoor... Tsarmander... Skwir- wait... Tsarmander would be the best Pokémon ever. King of Russia, and a goddamn lizard who breathes fire.

I, for one, welcome our new Tsarmander overlords.

Okey one thing now bugs me, if you are drawing the graphics isnt it still considered copyrighted by nintendo unless you are not basing the game off of the handheld pokemon and if you are than wouldn't nintendo still be able to scream copyright infringment since they came up with them in the first place even though you are drawing them yourself. To cover another point I am also refering to drawing the pokemon in different poses etc...

PU is different from the other MMOs in that it's NOT going to have a Cash Shop ingame. Nobody is making a penny off PU, so that will *probably* keep the Media Watchdog at bay.

There have been other pokemon mmos that were totally free and still shut down by Nintendo. Pokenet, a great pokemon mmo in the works, was shut down despite now getting a penny from any of the players and supporting the game by urging players to buy Nintendo merchandise. Point being, no pokemon mmo is safe from Nintendo. All I can say is I hope that PU is careful and learns from the past mmos' mistakes.
